Airplane - Crisis Fundraiser Terms and Conditions

1. Purpose

This fundraising campaign (“the Campaign”) is organized by Jack Bailey on behalf of Jack Bailey Music Limited as a free service, enabling Jack Bailey Music Limited to raise funds for Crisis UK, a registered charity working to end homelessness. Funds will be raised through:

  • Voluntary donations via GoFundMe.

  • Royalties generated from the streaming and purchase of the original song, Airplane (“the Charity Song”), released by Jack Bailey Music Limited (‘the Company’).

2. GoFundMe Donations

  • All donations made via the official GoFundMe campaign page (https://www.gofundme.com/f/help-airplanes-fundraiser-soar?lang=en_GB&utm_campaign=man_ss_icons&utm_medium=customer&utm_source=copy_link) shall be treated as charitable contributions.

  • 100% of the gross amount received through GoFundMe shall be donated directly to Crisis UK through GoFundMe and the Company will not be responsible for this transfer of funds outside of closing the campaign.

  • Transfers will be made via official donation channels in line with GoFundMe’s conditions and under will be less their platform fee, which the Company has no control over.

3. Music Royalties

3.1 Digital Purchase Royalties

  • Royalties received from the purchases of Airplane via platforms such as iTunes and Amazon Music shall be calculated net of platform fees and reasonable costs. Platform fees are taken before royalties are deposited into the account which can be drawn from.

  • The entire net amount (which for a £0.79 song will be within the range of £0.45 to £0.55 per sale) shall be donated to Crisis UK. A stop-date of 31 December 2025 will mark the end of the campaign, after which, royalties will be calculated and deposited to the Company within 3 months. After this time, the Company will make the donation of the net amount through Crisis UK’s official donation channels within 30 calendar days.

3.2 Streaming Royalties

  • Royalties generated from streaming platforms (e.g., Spotify, Apple Music, YouTube Music) shall be donated to Crisis UK up to a maximum cumulative total of £500 GBP.

  • This cap applies to all streaming royalties received between the song’s release date and 31 December 2025. The stop-date is needed due to the time taken to collect and calculate royalties from these services.

  • Once either the £500 threshold or the stop-date is reached, no further streaming royalties shall be collected for donation under the Campaign.

  • Streaming royalties will not be subject to a cost reimbursement to the Company but Jack Bailey Music Limited reserves the right to retain further royalty payments unless the terms of the Campaign are modified.

4. Accounting and Transparency

  • A financial summary of all funds raised and donated shall be published and shared no later than 31 June 2026.

  • This summary shall include:

    • Total GoFundMe donations received.

    • Total net royalties from digital purchases.

    • Total net digital streaming royalties.

    • Total donation.

5. Matched Donations

  • In support of Crisis Uk, as a registered charity in England and Wales, Jack Bailey as a representative of the Company will make a request to the Lloyds Bank Foundation for England and Waled for Matched Giving.

  • Within 30 days of the final charity payment, Jack Bailey will make a request to the Lloyds Bank Foundation for England and Wales to match the donated amount.

  • The Lloyds Bank Foundation for England and Wales will match any charitable donations up to £500 per eligible donator.

6. Amendments

  • These Terms and Conditions may be amended to reflect changes in platform policies, legal requirements, or unforeseen circumstances.

  • Any amendments shall be published publicly and dated accordingly. Continued participation constitutes acceptance of any revised terms.

7. Limitation of Liability

  • The Organizer shall not be liable for delays, errors, or omissions in fund transfers caused by third-party platforms.

  • No guarantees are made regarding the amount of funds that will be raised or donated.

8. Governing Law

  • These Terms and Conditions shall be governed by the laws of England and Wales.

  • Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
